Always before buying any cellphone make the dealer test it in front of you it will take only about 10min and you'll evade so much problems (During this process if an erreur occured the dealer will replace your phone even if you don't have a warranty).....
This is a fault with the speaker's design. The speaker is not making a good connection and is loose in the device. You have a couple options... Do a search on Google for the same problem with the N95. There you'll find the ****/blow trick. Basically, the idea is to blow into the speaker, you may hear it dislodge, you then **** in and the speaker will click back into place. I know this sounds completely stupid, but it is the same problem that plagued the N95 models... Nokia hasn't learned a thing in two years. Your other option is simply to send it to Nokia Support. It is about a 5 minute fix, but you may be without your device for a week or two with the whole transit/in/out times. the speakers are awful on my N85 too.
when i reach volume 40% the base just turns itself off, and can't hear half of the music signals....
a f/w would fix this? or....is it just s***e h/w
