it would be gray try to slide the button to the right hand side of the wi-fi logo to turn it on..if this still doesn't work try this settings->general->reset->reset network settings this should work if doesn't try to restore the ipod to the factory settings but it'll be at a cost of loosing all the data in the ipod.
