Safety features ... side stand up, bike in neutral, clutch pulled ... kill switch in RUN position ... then press the starter button or kick the kick start. good practices. You dont say a word about your make, model or year, BTW.

SHIFTING UP THROUGH THE GEARS OKAY BUT TRYING TO DOWNSHIFT THE LEVER WILL NOT RETURN TO POSITION IT WILL STAY UNTIL YOU TAP THE LEVER A FEW TIMES AFTER EACH GEAR. TRIED TO LUBRICATE DIDNT SEEM TO WORK.

The screws holding the backing plate for the gear selector fork may be loose, allowing a slight shift in alignment of return gear. There is a spring under some pressure holding everything in place, this maybe coming out of its location as well. It will require the removal of the sprocket cover and gear selector cover to access these retaining screws.
Depending on the type/model of the bike, it is a relatively simple motorcycle toolkit fix.
Would need to know specific bike for optimum advice, cheers.

Bike wont start, lights come on, has gas, wont kick start either

1st is all the way down, neutral is between 1st and 2nd. Sometimes hard to find.
The problem is probably a dead battery. Try to start it using a jumper cable off the car (if you know how) Get some help from someone who knows something about motorcycles.
Please have your son take some kind of lessons before he rides much. I don't want to cast a pall on his fun but he will be better off. (And live longer)
