Hi, please get the car scanned at your local parts chain and send us the trouble code. We can then provide advice for dealing with the dealer.

Not shifting after 40 mph, could it be something other than tranny issues??

Sounds to me like the car is in limp mode. This happens when the cars computers see something very wrong, and locks the transmission into second gear. This would explain the boggy feeling at take off and the limited speed. You should definitely get your check engine light checked out to see what code is there. Only then can you pursue the problem further.

The check engine light is telling you that there is a problem with the engine. As to it losing power it sounds as if the computer is putting it into limp home mode which is only about 30 mph or less. You need to put a scanner on the car and see the codes it is showing that will tell you what to do next. The check engine light should never be on unless there is a problem with the engine.

Engine managment light flashes (glow plugs light)

the car is going into limp mode due to an engine management fault. have to check what the fault is with a code reader. if the milage is high 100,000+ could be a turbo fault (overboosting), as this will put the car into limp mode.
