This sounds like a faulty brake light switch, located at the top of the brake pedal. try unplugging it to see if the brake lights then go out.

HI, this will be a damaged brake switch. it should be replaced, asap. Once replaced, the lights will operate correctly.

The switch is located under the driver side dash, near the brake peddle arm.
