With the age of this vehicle, there is a good chance that the hydraulic struts can no longer easily lift, and keep the tailgate open...even though the electronics work OK.
It is controlled through an electronic relay mounted in tailgate handle. If it has some rust then it doesn't close the circuit to release the lock. just clean the relay switch and it'll work (but to unmount this handle you'll need to open the gate first and then you'll access the switch by removing the plastic trim from inside the tailgate or better let it done by a mechanic or car electrician).
check the tailgate lock rods behind the handle. The bezel around the handle pops off, and the mechanism is behind there. The rods that go to each side of the tailgate may be stuck inward. A little wd-40 or lubricant should work them loose again
sometimes wires located in the pass through between the vehicles body and the lifgate can break due to the constant opening and closing of the lifgate.. inspect wiring in this passthrough for breaks.
On almost all trucks, you can open the tailgate, remove the straps either by un-bolting them at the bed or lifting the tailgate slightly and sliding the staps up to the larger part of the hole that slides over the pin. Remove the interior trim panel which will not be easy since the gate is up ---- you can then access the lock mechanism and will probably find a bent linkage rod or a broken plastic retainer clip.
Try to reset the tailgate by removing the no.7 (7.5 amp) fuse in the underdash fuse box. Open and close the tailgate manually, reinstall the fuse, and try the open tailgate button. If that doesn't work you would have take it to the dealer, where they can check for DTC's (diagnostic trouble codes). Honda Al
