They will try everything to avoid giving you money back.Think by law they have 4 attempts ,but if was me i would say you have nearly been involved in a serious accident and that even though you don't want to have to....you will contact trading standards.I find mentioning BBC Watchdog is good too !!
Testimonial: "well the fact that I have a 30 day warranty and I have only actually had it in my possession for a total of 6days and this will be the second time I will have to have it in a garage to fix the same thing...already I just don't want to deal with this car! ugh. also, they swore up and down before I bought it, that they have gone all over the car and there was nothing wrong anywhere was VERY miss leading! then when I picked the car up today from their "repairs" they told me they drove it 8 miles and the problem was fixed....well 2miles down the road I went and the same problem accured and now the 4th gear wont stay in!!"

I had similar issues on mine. I bought it from the Good Will for less than $1000. :)
It's been totaled i believe at least twice.
Anyways, replace the fuel filter. It's about the size of an oil filter and is very easy to replace.
Also, replace the spark plugs with some good titanium type plugs. They're like $4 from Wal Mart.
Next, put some fuel injector cleaner every other tank of gas or so. This will definitely help.
Good Luck

THE TURBINE SPEED (PART OF THE TRANSMISSION CONTROLS) SENSOR IS THE CULPRIT HERE, REPLACE IT.
SOURCE: auto transmition wont go into 3rd and 4th gear
I had the same problem I changed the transmission fluid & put a new filter in the trans, this fixed it good until I put my foot down to overtake the trans kicked down to 2nd gear & the hold light started flashing again & the trans started slipping again. I stressed over it for a day or 2 & then I took it out for a drive & thrashed it, Low & behold it came right. When you change fluid its impossible to get all the old fluid out because the torque converter holds a liter or two under pressure, so when I put my foot down some of the gunk blew through & blocked the pump it looses pressure & cant change gear. You need to get it flushed by a transmission specialist

Check transmission fluid. If that is full, try changing the fuel filter. It could be starving for gas, and trying to shift but can't. It could also be the speed sensor, or shift solenoid.
