The EP light turns on in case of a transmission issue, maybe there is a problem with the oil cooler, or your battery has reached its end-of-life. You can use an OBD device to check and reset codes, and the EP light may go away, if not, then its time to run diagnostics.
Go to the dealer, do not pass go, do not... You get the drift. The Transmission will function in a limited manner, but is not in a happy place.
As for a class action, go to North American Motoring and check the forums. They will probably have information on any action involving Mini's. They are at http://www.northamericanmotoring.com/
I found solution. In my case problem was with connection next to the small electronic module next to the gear wheel. It is module directing red light in proper 'P', 'R', 'N' and 'D' letter.
have you checked transmission oil?
I am not familar with MINI's but it sounds like either your transmission oil is low or is too thick (cold weather could do that) that the computer is safe gaurding you for destroying your transmission or you computers messed up.
Recommendation: get the car to a shop ASAP before you do serious damage.
thank you for your help its most appreciated
