This problem is caused by a defective brake light switch, the switch is either out of adjustment (it is a threaded adjustment) or is defective, it is located under the dash and at the top of the arm the brake pedal is attached to. There will most likely be a plastic panel under the dash you will need to remove to see the switch. Here is a picture of the brake light switch.
Could also be a defective brake light switch pad (a grommet like pad that the brake light switch button rests against.) If the pad is missing, then with the pedal all the way up the brake light switch button will just go through the hole that the pad would have filled and the lights will stay on. Looks for some rubber debris on the floor as a tell-tale sign.
